HOW THE WAR ON SEX WORK IS STRIPPING YOUR PRIVACY RIGHTS
California law enforcement agencies are systematically and pervasively violating civil liberties and privacy rights.
These are the key findings of the Erotic Service Provider Legal, Educational and Research Project (ESPLER) Inc. Project, which analyzed the tactics and methods used by County Sheriffs, District Attorneys, Probation & Police Departments to secure prostitution and loitering citations and /or arrests during the period of January 1, 2020, to February 28, 2022.

ESPLER’s report is based on the responses to public records requests from 55 district attorneys, 6 probation departments, 25 sheriff’s departments, and 41 police departments in California.
Despite lack of cooperation and transparency from law enforcement, (no agency provided all of the requested records as required by the CPRA), a disturbing and persistent pattern of privacy violations emerges from the partial responses.

California law enforcement agencies are utilizing invasive surveillance technologies like facial recognition software, warrantless digital data scraping & collection programs, and license plate capture/recognition cameras to create and archive biometric profiles of Californians without their consent or knowledge. Surveillance cameras are indiscriminately recording individuals in areas that often overlap with traditionally marginalized communities. Transgendered and gender-nonconforming people have been profiled, harassed, and arrested simply for existing in public spaces.
ESPLER is committed to continuing to uncover information about the egregious methods used by law enforcement agencies and working with state legislators to protect the privacy rights of Californians.
